Calif Same-Sex Marriage Ban Overturned in Federal Court

RedTracker| A federal court overturned California’s voter-approved ban on same-sex marriage on Wednesday, giving a temporary victory to supporters of gay marriage and almost insuring that the issue is headed to the US Supreme Court.

“Proposition 8 cannot withstand any level of scrutiny under the Equal Protection Clause,” wrote Judge Walker. “Excluding same-sex couples from marriage is simply not rationally related to a legitimate state interest.”

The plaintiffs’ case was argued by David Boies and Theodore B. Olson, ideological opposites who came together around this issue. Read on at NYTimes
